In Greene County district court Bryan Gene Snell, 33, of Coon Rapids was sentenced to five years in prison after he changed his plea to guilty to a charge of operating while intoxicated- third offense. The prison term was suspended and he was placed on probation for two years. He must live at a residential correctional facility until he receives the maximum benefits. He must follow the recommendations of a substance abuse he has already undergone, and he must attend a community college drinking driver’s school. His driver’s license was revoked for six years.
Snell was fined $3,125 with a $1,093.75 surcharge and a $10 surcharge for drug abuse resistance education (DARE). The judge determined Snell is unable to pay restitution for his court appointed attorney’s fees. A charge of possession of methamphetamine and two counts of interference with official acts in magistrate court were dismissed. Court costs were $140. (Sentencing: Honorable Joseph B. McCarville)
Zachery Allen Waters, 21, of Paton was sentenced to one year in jail after he changed his plea to guilty to a charge of assault on a peace officer. The jail time was suspended and he was placed on probation for two years. He is to reside at a residential correctional facility until maximum benefits are received. He must also undergo a substance abuse evaluation and complete any recommended treatment at his own expense. On that charge he was fined $315 with a $110.25 surcharge. On a charge of domestic abuse assault causing injury or mental illness he was sentenced to two years in prison, concurrent to the first. The jail time was suspended and he was placed on probation for two years, also at a residential correctional facility. The substance abuse evaluation and treatment is part of the disposition on that charge as well. Waters was fined $625 with a $218.75 surcharge. A charge of harassment- first degree and a charge of domestic abuse assault impeding blood/air flow was dismissed. Court costs were $140. (Sentencing: McCarville)
Damien Michael Schwering, 25, of Scranton was sentenced to 30 days in jail after he pleaded guilty to a charge of operating while intoxicated- first offense. All but two days were suspended and he was placed on informal probation for one year Schwering must pay sheriff’s room and board fees for the jail time he serves. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He may attended the Des Moines Area Community College weekend offender program at his own expense, and he must complete a community college drinking driver’s school. He was fined $1,250 with a $437.50 surcharge and a $10 DARE surcharge.
On a charge of assault, amended from domestic abuse assault- second offense, Schwering was sentenced to two days in jail, concurrent to the jail time in the previous charge. He was fined $100 with a $35 surcharge. Court costs were $131.50. (Sentencing: Honorable Joseph B. McCarville)
Erica Murphy, 26, of Jefferson was granted a deferred judgment after she pleaded guilty to a charge of possession of methamphetamine. She was placed on informal probation for one year. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. She must pay a $315 civil penalty with a $125 law enforcement initiative (LEI) surcharge. Joe Edward Blackmon, 41, of Jefferson was sentenced to two days in jail after he pleaded guilty to a charge of domestic abuse assault- first offense. He must pay sheriff’s room and board fees for the time he serves. The jail time is concurrent to the ail time in two other Greene County cases. The sentencing specified that Blackmon may not possess, ship, transport or receive firearms, offense weapons or ammunition. He must also complete a domestic abuse program at his own expense. Blackmon was fined $315 with a $110.25 surcharge. Court costs were $146.50.
Persons pleaded not guilty at arraignment as follows: Robert Christopher Jean Thoma Jr, 19, of Scranton, possession of marijuana- first offense; Erick Paul Johnson, 46, of Jefferson, dependent adult abuse- exploitation greater than $100, and theft- first degree; Jodi Ann Ganoe, 43, of Jefferson, possession of marijuana- first offense and Kelsey Marie Badding,OWI- first offense . Trial dates were set for Jan. 23 in every case.
Cases were initiated in district court as follows: Brayden Michael Habben, 18, of Grand Junction, possession of marijuana- first offense; Adam James Stilson, 19, of Polk City, intimidation with dangerous weapon to injure/provoke fear, harassment- first degree, criminal mischief- third degree, and reckless use of firearm- property damage; Jake Allen Cretsinger, 19 of Waukee, intimidation with dangerous weapon to injure/provoke fear, harassment- first degree, criminal mischief- third degree, and reckless use of firearm- property damage; Shawn J. Gifford, 27, of Jefferson, driving while license barred; and Charles Samuel Wol, 43, of Jefferson, domestic abuse assault with intent to inflict serious injury.
